The Kenya Roads (Amendment) (No.2) Bill, 2025 (National Assembly Bill No. 16 of 2025) has been signed into law.
The principal object of the Bill now Act is to amend section 13(3) of the Kenya Roads Act, Cap. 408, to align the term of offices of Director-Generals of various roads authorities with the Mwongozo Code of Governance for State Corporations.
The Code of Governance for State Corporations provides that Chief Executive Officers or equivalent positions of state corporations shall serve for a term of three (3) years, renewable once, subject to satisfactory performance of the person holding office.
To this end, the Act has amended section 13(3) of the Kenya Roads Act to provide that a Director-General of each Authority, these being the Kenya Rural Roads Authority (KERRA); the Kenya Urban Roads Authority (KURA); and the Kenya National Highway Authority (KENHA) shall serve for a period of three years, renewable once.
The term of office is intended to enhance performance and promote good governance in the management of the road authorities which is the practice for all state corporations.
Further, the Act makes a consequential amendment to section 12(4) of the Kenya Roads Board Act, Cap. 408A to also align the term of office of the Director-General of the Kenya Roads Board with the Mwongozo Code of Governance for State Corporations which prescribes a term office of three years, renewable once.
Finally, to ensure seamless transition, the Act has a transition provision and stipulates that a person who, immediately before the commencement of the Act, held office as a Director-General shall serve for the unexpired period of his or her term and shall be eligible, for a person serving the first term, for re-appointment for one further term of one year.
