The Senate Justice, Legal Affairs, and Human Rights Committee (JLAHRC), chaired by Senator Wakili Hilary Sigei, convened to consider a petition by Laban Omusundi seeking a legal framework for the direct citizen-led recall of the President and Governors. Omusundi, an active petitioner from Nakuru, argues that while the Constitution allows the recall of MPs and MCAs, the lack of a similar mechanism for the executive branch entrenches impunity.

โ€œA Republic where citizens can recall MPs but are powerless against compromised Presidents or Governors betrays the spirit of the 2010 Constitution,โ€ Omusundi stated during the session. โ€œThe people must remain the ultimate custodians of power, not spectators to elite bargainsโ€.

The proposal faced resistance from legislators. Professor Tom Ojienda questioned the necessity of the move, asking, "Mr. Omusundi, donโ€™t you think the provisions to impeach are sufficient? The electorate has five years to decide. Why not let them be impeached or wait for the ballot?"

Senator Okiya Omtatah was even more direct, labelling the proposal a "referendum issue" that risks overstretching the law. "The Constitution is not like clay or elastic that you can stretch the way you want," Omtatah remarked. "This matter was struck out of court previously; you should not reduce this Constitution to a pilot paper."

However, Senator Daniel Maanzo supported, noting the vulnerability of current oversight. "Though the Constitution envisages impeachments, it could be difficult when we have a captured Parliament and easily compromisable County Assemblies," Maanzo observed.

The committee, having heard Omusundiโ€™s plea to restore "people's sovereignty," adjourned to a later date to deliberate further and draft a formal report.
